Presentación
Este curso se enfoca en el desarrollo de las habilidades comprensivas de los abogados que tengan interés en el derecho penal y procesal penal de los Estados Unidos. Se trabajará la comprensión de textos y la comparación de institutos a partir de la lectura de jurisprudencia, doctrina y otros materiales relevantes.
El foco estará puesto en los institutos del derecho penal y procesal penal federal de los Estados Unidos y del estado de Nueva York. Aunque la atención estará puesta en la terminología y la fraseología del derecho en inglés estadounidense, se harán comparaciones con legislaciones penales y procesales penales de Latinoamérica.
Contenido
Criminal Procedure Terminology. Structure of criminal proceedings, from an arrest to the appellate stage. Analysis of diferent terms, legal synonyms, and the diferences between the federal system and the state systems that differ from the federal system.
Criminal Procedure Terminology. Comparison between the U.S. criminal procedure and inquisitorial and adversary systems throughout Latin America. Overview of the structure of the federal and New York State courts. Analysis of judgments, orders, and other court decisions. Assessment of charging instruments and their relation to the preliminary proceedings.
Criminal Procedure Terminology. Prosecutorial discretion within the accusatorial system, such as diversion programs, deferred prosecutions, and plea agreements. An overview of alternatives to incarceration, such as impaired-driver, drug-treatment, and batterer-intervention programs.
Criminal Law Terminology. Analysis of terms under the general principles of U.S. criminal law. Synonyms and diferences among the jurisdictions based on the common-law traditions and the Model Penal Code. An outline of elements of crimes, such as mens rea and actus reus, of ofenses from petty to major, and of the distinctions between inchoate and preparatory crimes.
Criminal Law Terminology. Terminological analysis of specific crimes in U.S. criminal law. Synonyms and diferences among the jurisdictions based on the common-law traditions and the Model Penal Code. A focus on the diferent types of murder and manslaughter statutes as well as assault and battery ofenses.
Charging Instruments — Understanding accusatory instruments, i.e., criminal complaints, prosecutor’s informations and indictments, including statements of the facts therein and the charges stemming thereof.
